Crypto Securities: SEC Classifies Terra Luna, Polygon

The SEC recently filed litigation against Consensys, clarifying that Terra Luna Classic (LUNA), Polygon (MATIC), The Sandbox (SAND), Chiliz (CHZ), and Decentraland (MANA) are securities. This action targets Consensys for allegedly facilitating the trading of these assets via its MetaMask Swaps platform.

The SEC argues these tokens were marketed with promises of future profits driven by the efforts of their issuers. For instance, MATIC’s whitepaper and statements by Polygon’s co-founder emphasized potential value increases tied to the network’s growth. Similarly, MANA’s ICO and trading activities implied profit from Decentraland’s platform success.

CHZ was promoted for fan engagement within sports, with funds raised for platform development. SAND’s initial offering portrayed it as an investment vehicle tied to The Sandbox’s success. Terra Luna Classic’s marketing and statements by Terraform’s leadership further reinforced expectations of profit.

This classification by the SEC highlights the need for regulatory clarity in the rapidly evolving crypto space, ensuring investor protection and market integrity.
