Ripple, Coinbase Challenge SEC Using Binance Victory

Coinbase and Ripple Labs are leveraging Binance’s recent court win to challenge the U.S. SEC’s regulatory claims. Both companies argue that the SEC needs to provide clearer, more consistent guidelines for digital assets.

Ripple highlights a judge’s remark that current securities laws don’t fit well with cryptocurrencies. This is significant as it questions the applicability of the 1946 Howey Test to crypto transactions. Coinbase also calls for formal rulemaking, citing the same Binance case to push for regulatory clarity.

Judge Analisa Torres ruled that some sales of Ripple’s XRP did not constitute securities transactions. This nuanced interpretation is now a key point in Ripple’s defense. Coinbase, facing similar issues, argues that current SEC practices are inefficient and unclear.

The partial dismissal of SEC claims against Binance, especially regarding secondary sales of Binance Coin, serves as a pivotal precedent. This ruling strengthens the push for a clear regulatory framework, crucial for the crypto industry’s stability and growth.
