Jonathan Mann, a prolific songwriter, and artist Brian L. Frye have sued the US SEC over the classification of NFTs as securities. Mann, known for his daily songs for over 16 years, argues NFTs of their digital art should be exempt from securities laws.
The lawsuit challenges the SEC’s broad interpretation of the Howey test, which could impact all art forms. Mann plans to release 10,420 unique NFTs, while Frye will offer 10,320 NFTs, both awaiting court approval.
