Six blockchain organizations urged the U.S. Securities and Exchange Commission on Oct. 20, 2026, to put a digital-commodity definition and legal status into its proposed Regulation Crypto Assets rules. The rules were still in draft form. The group said binding rules would reduce uncertainty about token classification and secondary-market trading.
The organizations also asked the SEC to preserve classifications they said were set out in March 2026 guidance, and to confirm that the proposed Rule 400 safe harbor would be voluntary. Their proposed approach to secondary sales would generally exclude a sale by someone other than the issuer from involving an investment contract only if the issuer’s promises of material managerial efforts were no longer in effect. Ripple Labs separately supported the draft rules and urged the SEC to finalize them.
