EU Regulator Considers Approving Bitcoin for UCITS Products

The European Securities and Markets Authority (ESMA) is deliberating on whether to integrate Bitcoin into the EU’s €12 trillion mutual fund market, specifically within Undertakings for Collective Investment in Transferable Securities (UCITS). This groundbreaking consideration, announced on May 9, 2024, could mark the first significant entry of Bitcoin into mainstream European investment, following similar ETF approvals in the US and Hong Kong. A unique aspect of this development is the potential to diversify UCITS funds with Bitcoin, enhancing liquidity and promoting broader EU adoption without necessarily creating Bitcoin-only funds. With over 75% of EU citizens’ funds in UCITS, a Bitcoin inclusion could dramatically increase the cryptocurrency’s liquidity and market presence. Before finalizing its decision, ESMA is collecting feedback until August 7, indicating the careful and inclusive approach to this significant shift. This move could strategically position the EU at the forefront of global financial innovation, acknowledging Bitcoin’s increasing relevance.
