Tornado Cash Founder Trial Delayed to December

A federal judge has postponed the trial of Roman Storm, co-founder of Tornado Cash, to early December. The trial, initially set for September, will now take place in the first two weeks of December.

This delay follows a long legal battle over the legitimacy and functions of Tornado Cash, a cryptocurrency mixing service. Judge Katherine Polk Failla of the Southern District of New York approved the delay, citing the need for thorough preparation due to the complex legal issues involved.

The main issue is whether Storm can be held accountable for the actions of Tornado Cash users, including alleged money laundering by North Korean hackers. The defense argues that Storm had no control over Tornado Cash after May 2020.

The case is significant as it questions making developers responsible for users’ criminal activities, a first in money laundering cases with no direct control over the money. Judge Failla will later decide on key motions related to evidence and the extent of search warrants.

This trial could set a precedent for the responsibilities of software developers in preventing illegal activities, highlighting its strategic importance in the tech and legal fields.
