House Oversight Committee Chairman James Comer opened an investigation on October 26, 2026, into Delaware’s proposal for companies run by AI agents. In a letter to Gov. Matt Meyer, Comer warned that the plan could shield AI firms and investors from responsibility for harm. He requested records on the proposal, including internal AI chat logs and safety concerns, by November 9.
The plan is still a proposal; state lawmakers are expected to consider draft legislation in January. Under it, AI-run companies would operate only in a 30-month supervised regulatory sandbox, disclose their status to counterparties and be barred from banking. A company’s sole member would generally be shielded from its debts, but not if it failed to provide adequate capital or used the company for fraud or a willful violation of law. Delaware’s secretary of state says the aim is to define where liability falls, not to shield it.
