French authorities proposed changes to the EU’s Markets in Crypto-Assets Regulation that would make regulated crypto platforms liable for certain incidents affecting clients when the platforms actively facilitate access to decentralized finance (DeFi) protocols. The duties would include vetting protocols before offering access and monitoring for vulnerabilities and suspicious activity. MiCA currently excludes fully decentralized crypto services without intermediaries; the proposed duties would apply fully to significant providers and be scaled for smaller ones.
Platforms could still offer access to uncertified protocols if they conduct their own due diligence and give enhanced risk disclosures. The proposals are a response to a European Commission consultation, not an approved change to the law. The responses will inform a report to EU lawmakers due by June 30, 2027, which could include proposed amendments.
