SEC Fined $1.75M for Misconduct in Debt Box Case

In a landmark ruling, U.S. District Court Judge Robert J. Shelby ordered the Securities and Exchange Commission (SEC) to pay over $1.75 million in legal fees and costs in the Debt Box case. The decision was made after the judge deemed the SEC’s conduct as misleading and in bad faith.

The ruling includes $1 million for attorney fees and approximately $750,000 for receivership fees. The case initially involved the SEC charging Debt Box with a $50 million fraud, alleging that funds were moved internationally. However, it was later revealed that the funds were transferred within the United States.

Judge Shelby criticized SEC attorney Michael Welsh for not correcting misstatements and perpetuating false narratives. This was seen as a “gross abuse of the power entrusted to it by Congress,” undermining the integrity of the proceedings.

This ruling emphasizes the importance of accountability and transparency in regulatory actions, potentially reshaping how such cases are handled in the future.
