Coinbase Narrows Subpoena on SEC Chair Gensler

Coinbase has refined its subpoena to focus solely on SEC Chair Gary Gensler’s communications from his tenure starting in April 2021. Initially, Coinbase sought access to Gensler’s private communications dating back to 2017, but Judge Katherine Polk Failla’s concerns led to narrowing the scope.

Gensler’s pre-chair period included teaching a “Blockchain and Money” course at MIT in 2018. Coinbase aims to use this information to illustrate Gensler’s evolving views on crypto regulations. The opening brief for document production is due July 23, with the SEC’s response by August 5.

In June 2023, the SEC accused Coinbase of listing 13 tokens as unregistered securities, conflicting with Coinbase’s stance that these tokens do not qualify as securities. Despite legal challenges, Bank of America upgraded Coinbase’s stock rating, signaling improved market confidence.

This strategic refinement of the subpoena underscores the ongoing battle over crypto regulation, highlighting the pivotal role of Gensler’s recent tenure in shaping the future landscape.
