Judge Approves Fast-Track for Consensys SEC Suit

A U.S. judge has approved an expedited schedule for Consensys’ lawsuit against the SEC. Judge Reed O’Connor’s decision on July 1 means the court will quickly address whether the SEC has the authority to regulate MetaMask as a securities broker and issuer.

Bill Hughes, senior counsel for Consensys, shared details of the ruling, noting the significance of considering these issues promptly. The SEC must respond by July 29, with opening briefs due by September 20, 2024, and opposition briefs by November 1, 2024. A ruling could come by December, around Christmas.

This case marks a pivotal moment as it addresses the regulatory scope over blockchain technology and digital assets. The lawsuit follows the SEC’s recent actions against Consensys’ MetaMask platform. Consensys previously sought a ruling that Ethereum is not a security and MetaMask is not a broker dealer.

Judge O’Connor’s decision highlights the ongoing legal and regulatory challenges in the evolving crypto landscape, underscoring the importance of clear regulatory boundaries.
