SEC, CFTC Make Nine Crypto Rulemaking Moves

The U.S. Senate failed to advance the CLARITY Act on September 15, 2026, when a cloture vote fell 49–50, 11 votes short of the 60 needed. The source says the bill is dead for 2026, but the SEC and CFTC said they would continue work on crypto rules under existing authority.

On September 17, the SEC issued a five-year, conditional Innovation Exemption for venues trading tokenized U.S. stocks, and the CFTC cleared a path for crypto developers to build trading tools without broker registration. The exemption is temporary and volume-capped. Agency rules could be reversed by a future commission, and a proposed CFTC crypto market rule remains under White House review rather than being final.
