Paul Clement Backs Crypto in Fed Dispute

Former Solicitor General Paul Clement has joined the crypto industry’s legal battle by filing an amicus brief supporting Custodia Bank’s appeal against the Federal Reserve’s denial of a master account. The brief was filed a week after Custodia Bank’s appeal in the 10th Circuit Court.

Clement’s involvement marks a significant step, given his notable success in overturning the Chevron Defense in the Supreme Court. The Digital Chamber (TDC) and the Global Business Blockchain Council-USA (GBBC-USA) argue that denying state-chartered banks access to national banking due to digital assets hampers blockchain industry growth.

The case’s outcome could set a precedent for how other industry players interact with the Federal Reserve. Clement has raised constitutional concerns about the Fed’s structure, highlighting the risk of granting unchecked power to federal officials, which could stifle innovation.

The decision’s long-term impact could shape the future of blockchain and digital assets in the financial sector, emphasizing the strategic importance of this legal battle.
